California-FMCSA Court Fight Tests Non-Domiciled CDL Issuance Pause

California and the Federal Motor Carrier Safety Administration presented arguments September 11 over a federal pause affecting the state's non-domiciled commercial driver license program. FreightWaves reported that a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit heard California Department of Motor Vehicles v. U.S. Department of Transportation. The court had not issued a decision when the hearing ended.

The dispute centers on FMCSA's audit, California's corrective response and whether the agency lawfully stopped the state from issuing or renewing non-domiciled CDLs. Federal officials also froze some highway funding. A major issue is whether a license may remain valid beyond the expiration of the holder's lawful-presence document. In its brief, the federal government alleged that roughly 20,000 of about 65,000 reviewed credentials had that mismatch. California disputes FMCSA's legal interpretation and the scope of the agency's authority.

The pause is narrower than a statewide CDL decertification. It applies to new and renewed non-domiciled credentials, not every California commercial license. The appellate case also does not establish a new nationwide rule today. A separate challenge involving tightened federal non-domiciled CDL requirements is scheduled for argument before the same court, and the outcomes could clarify how states verify eligibility and set expiration dates.

Applicants, schools and carriers should rely on current DMV and FMCSA instructions while the litigation continues. A driver should confirm license status before operating, and employers should document credential checks without assuming that a pending lawsuit has restored issuance. Training providers can help students distinguish a non-domiciled credential from an ordinary state-domiciled CDL. Any future court order or agency notice may change the process, but speculation is not a substitute for the official status shown by the licensing authority.
