
The Food and Drug Administration has finalized an order removing a major device-approval obstacle that delayed oral-fluid drug testing for truck drivers and other federally regulated workers. Commercial Carrier Journal reported October 7 that FDA expanded exemptions from the 510(k) premarket-notification requirement to include certain clinical toxicology devices intended for federal workplace drug-testing programs.
A 510(k) filing normally requires a manufacturer to demonstrate that a device is substantially equivalent to a legally marketed product. The exemption reduces that regulatory burden for qualifying devices, helping manufacturers move oral-fluid collection and testing products toward the federal program. FDA's official medical-device updates confirm the final action involving certain clinical toxicology test systems.
Oral-fluid collection is directly observed, which can make substitution and some other forms of tampering more difficult than with urine specimens. Federal transportation agencies authorized oral-fluid testing in 2023, but implementation stalled because the required laboratory and device infrastructure was not ready. The FDA action removes one hurdle; it does not by itself mean motor carriers can immediately replace their current DOT testing process.
For now, trucking employers should continue using the testing methods permitted under current DOT procedures and wait for official DOT and Department of Health and Human Services implementation guidance. Policies, collector training, laboratory relationships and employee notices should change only after the federal prerequisites are satisfied. Carriers can prepare by reviewing consortium and third-party administrator contracts, identifying how directly observed collections would be handled and monitoring official agency notices. Drivers should understand that any future oral-fluid program remains a regulated safety process with chain-of-custody, laboratory and medical-review requirements.
