Federal Court Blocks Transfer of 17 Million CDLIS Driver Records

A federal judge has temporarily blocked the transfer of more than 17 million commercial-driver records while states challenge the Department of Transportation's demand for the nationwide CDLIS database. Overdrive reported the August 21 order and updated its coverage August 23. The case involves 21 states and the District of Columbia against DOT and the Federal Motor Carrier Safety Administration.

Senior U.S. District Judge Anthony J. Trenga issued a temporary restraining order preventing the American Association of Motor Vehicle Administrators from transferring the requested data to FMCSA or another federal agency. The order also prevents FMCSA from taking adverse action against the states or AAMVA while the court considers broader preliminary-injunction relief. The requested records include sensitive identification information collected through state CDL programs.

The judge concluded that the states had shown a likelihood of success on several claims and a risk of irreparable harm from a large disclosure. This is an interim order, not a final decision on whether federal agencies may ultimately obtain the data. States must file their preliminary-injunction motion by August 27, the federal response is due September 3 and a hearing is scheduled for September 10.

For CDL holders, the order does not cancel licenses, alter renewal dates or create a new qualification requirement. Drivers should continue using their state licensing agency's normal process and should be skeptical of unsolicited messages requesting Social Security numbers or identity documents in connection with the dispute. Schools and carriers should keep permit, training and driver-qualification records secured and limit access to employees with a legitimate need. The immediate effect is narrow: the bulk CDLIS transfer is paused while the court reviews the legal questions.
