FMCSA Doubles Military CDL Waiver Eligibility Window to Two Years

FMCSA has temporarily expanded the eligibility window for qualified current and former military service members using the Military Skills Test Waiver and Even Exchange programs. The waiver extends the relevant period from one year to two years after qualifying military employment. It also allows eligible active-duty personnel to seek a commercial learner's permit or commercial driver's license in the state where they are stationed, even when that state is not their domicile.

The waiver took effect October 30, 2026, and expires January 29, 2027. It covers the Army, Navy, Marine Corps, Air Force, Space Force and Coast Guard, including associated reserve and National Guard units. Applicants must still document qualifying military work that required commercial motor vehicle operation and satisfy the remaining conditions in federal regulations. The waiver changes the time window; it does not eliminate every eligibility, medical, licensing or state documentation requirement.

State participation is important. FMCSA strongly encourages states to adopt the waiver, but the underlying military programs allow rather than require a state to waive specified knowledge or skills tests. A service member should therefore confirm implementation, forms and evidence requirements with the licensing agency before making an appointment. The official document says the agency considers the limited waiver in the public interest and expects safety equivalent to the existing rule.

For CDL schools and career advisers, the practical step is to screen military experience dates before placing an applicant into a full testing pathway. Applicants outside the former one-year window may now qualify during the temporary period, but approval belongs to the state. Schools should avoid promising an automatic test waiver and should explain that endorsements, medical certification and any nonwaived testing may still apply. Keeping copies of duty records and vehicle-operation evidence can help the licensing agency review the application efficiently.
