FMCSA Grants Five-Year Warning-Beacon Exemption for Level 4 Trucks

The Federal Motor Carrier Safety Administration has granted a five-year exemption allowing eligible Level 4 autonomous trucks to use a cab-mounted warning beacon when stopped on the roadway instead of relying on a human driver to place reflective triangles. FreightWaves reported the decision October 8, and the official Federal Register notice was published October 9. The exemption took effect October 7 and runs through October 7, 2031.

The decision covers Aurora Operations and other motor carriers operating Level 4 automated-driving systems without a conventional driver, provided they notify FMCSA before using the exemption and meet its conditions. It addresses requirements governing placement of warning devices, steady-burning lamps and the permitted type and number of warning devices. FMCSA reviewed 402 public comments and determined that the alternative could achieve a level of safety equivalent to or greater than the existing rules.

The beacon must satisfy the specifications and operating conditions in the agency's decision. This is not a blanket removal of roadside-warning duties and does not apply automatically to conventional trucks. Participating carriers remain responsible for lawful operation, vehicle condition and compliance with every requirement not specifically covered by the exemption. FMCSA may revoke the exemption if safety performance or compliance no longer supports it.

For CDL drivers and roadside personnel, the practical change is situational awareness. A stopped driverless truck may signal its presence from the cab rather than through triangles set behind the vehicle. Drivers approaching a disabled commercial vehicle should slow down, move over when required and follow law-enforcement direction. Fleets testing autonomous equipment should train dispatch and response teams on the exemption's exact conditions, notification process and incident-reporting responsibilities before relying on the beacon alternative.
