FMCSA Says ELD Rules Need Rewrite as Cyber and Fraud Risks Grow

Federal Motor Carrier Safety Administration leaders are asking trucking companies to share more intelligence as the agency confronts cybercrime, cargo theft and electronic logging device vulnerabilities. Transport Topics reported October 2 that Deputy Administrator Jesse Elison addressed the National Motor Freight Traffic Association Cybersecurity Conference in Long Beach, California, and described industry participation as essential to safer enforcement.

Elison said ELDs remain a particular weak point because federal rules allow manufacturers to self-certify that devices meet technical standards. He reported that tougher vetting since the beginning of 2025 has kept hundreds of applicants from being certified and removed nearly 100 providers. FMCSA is considering revisions to the ELD framework while continuing work on Motus, its centralized carrier-registration portal, and coordinating fraud information with federal prosecutors and law-enforcement partners.

Official FMCSA notices confirm the enforcement trend. The agency repeatedly removed devices from its registered list during 2026 for failing minimum requirements in 49 CFR Part 395. Carriers using a revoked device generally receive a replacement window, then risk being treated as operating without a compliant ELD and placed out of service if they miss the published deadline.

Fleets should treat ELD selection as both a compliance and cybersecurity decision. Check the FMCSA registered and revoked-device lists before purchasing or renewing service, assign someone to monitor agency notices, preserve paper-log contingency procedures and review vendor access to driver and vehicle data. Report suspicious provider activity, identity misuse and cargo-fraud patterns through established channels. A low-cost device can become expensive quickly if it exposes credentials, corrupts hours-of-service records or forces an unplanned fleetwide replacement.
