Illinois Truck Driver Ruling Tests Independent-Contractor Classification

An Illinois federal court ruling has classified a group of Sparc Transport drivers as employees under state law, advancing a closely watched trucking misclassification case. Land Line Media reported September 10 that U.S. District Judge Elaine Bucklo decided the central employment-status question in favor of the drivers. The ruling is specific to the facts, parties and Illinois law in this lawsuit; it is not a nationwide rule for owner-operators.

The class action alleges that drivers worked exclusively for the carrier, received loads through company dispatchers and operated trucks displaying its logo and USDOT number. The plaintiffs also said they could not negotiate pay rates and faced deductions for truck and trailer rental, fuel, tolls, insurance, ELD service and license plates. Sparc Transport disputed the drivers' employee status.

Illinois applies an ABC test. A business must show that a worker is free from its control, performs work outside the company's usual business or places of business, and operates an independently established trade or business. The court found the drivers were employees under that framework. The case remains open, including claims concerning deductions, expenses and a lease-purchase agreement, unless the parties settle.

Carriers and drivers should avoid treating a contract label as the entire classification analysis. Day-to-day control, economic independence, dispatch practices, equipment arrangements and applicable state law can all matter. Fleets using contractor models should have qualified counsel review agreements and actual operations together, while drivers should keep copies of settlement statements, deductions, lease terms and communications. The decision does not resolve every dispute, but it underscores that worker classification can affect wages, expenses, taxes and liability long after a load is delivered.
