IRS Dyed Diesel Relief Runs Through December 31 but State Taxes Still Apply

Truckers may use red-dyed diesel on public highways without federal fuel-tax penalties through December 31, but the relief does not automatically erase state taxes. Land Line Media reported October 16 that the IRS clarified how the temporary policy works after an October 5 executive order. The agency's official notice makes the relief retroactive to October 1 and applies nationwide to sellers and highway users of dyed diesel.

Ordinarily, dyed diesel is reserved for tax-exempt off-road uses such as farming, construction and industrial equipment. During the relief period, the IRS says it will suspend ordinary federal collection and enforcement procedures, reassign fuel-compliance officers and conduct no federal inspections of on-road dyed-fuel use. Penalties tied to the federal excise tax, deposits and related recordkeeping will not be imposed. Further IRS guidance is still expected for Form 720 and deferred tax payments.

State treatment remains separate. The IRS explicitly says its action affects only federal taxes and penalties. Land Line also reported that miles still must be reported through IFTA. Unless a state grants corresponding relief, fuel bought without state excise tax generally cannot be claimed as a tax-paid purchase, leaving the carrier responsible for the jurisdiction's tax through its IFTA return.

Carriers considering dyed diesel should check every operating state's current order before fueling, retain purchase records and brief accounting teams on how the transaction will be reported. A federal pause is not permission to assume every tax disappeared. Drivers also should follow company fueling instructions instead of choosing dyed fuel based only on pump price. The practical savings will depend on availability, state rules and forthcoming federal guidance, so disciplined documentation remains the safest approach.
