States Sue Over Federal Demand for 17 Million CDLIS Driver Records

A coalition of states is asking a federal court to stop the U.S. Department of Transportation and Department of Homeland Security from obtaining Commercial Driver's License Information System records. Land Line Media reported August 14 that separate filings challenge demands involving names, dates of birth, license information and Social Security numbers tied to approximately 17 million commercial drivers.

The official DOT complaint was filed August 13 in the U.S. District Court for the Eastern District of Virginia by 21 states and the District of Columbia. It says FMCSA required the American Association of Motor Vehicle Administrators to produce five years of CDLIS records by August 17 or risk termination of federal contracts and funding. A related action challenges a DHS subpoena seeking the same data. These are allegations awaiting judicial review, not findings that either agency violated the law.

DOT disputes the states' position. In an August 14 response, the department said federal officials have historically accessed the database and argued that the information is needed for CDL oversight and roadway safety. The states counter that CDLIS is operated through AAMVA to help licensing agencies prevent multiple licenses and identify disqualifying records, not for an unrestricted federal data transfer. The dispute therefore centers on authority, privacy protections and the permitted use of sensitive driver information.

Nothing in the filings creates a new CDL qualification, cancels a license or changes a renewal deadline. CDL holders should continue using their state licensing agency's normal process and should not send identity documents in response to unsolicited messages claiming to be part of the case. Schools and carriers should secure permit and qualification records, limit access to staff with a business need and follow retention rules. Court orders will determine whether the requested transfer proceeds.
